Constitution DAO is making a second attempt to buy the U.S. ConstitutionThe DAO failed the first time, but came very close to buying the Constitution. This time around, the DAO is allowing members to make private contributions to mask how much it has to invest. Smart move!

A California judge has ruled that the Commodity Futures Trading Commission (CFTC) must serve specific DAO members rather than the entire Ooki DAO. In October, the CFTC sued the Ooki DAO and served the DAO through an online discussion forum. Now, it appears, the CFTC will have to serve the individuals in the DAO, specifically the founders, rather than the DAO itself. Of course, the legal system allows the CFTC to make an appeal to a higher court and attempt to overturn that ruling. I suspect that is what the CFTC will do, which will drag the case out longer as the parties make their arguments before the appellant court. It could go all the way to the Supreme Court before a determination is made on the nature of DAOs. It’s an important case because it gets to the heart of whether CFTCs should be treated as traditional business entities, which are considered fictitious persons according to the law. DAOs should not be treated as fictitious persons as they are non-hierarchical entities where all the members are equals based on their stake within the organization. There aren’t officers and traditional organizational representatives. It’s more like a co-op than a business. I can’t wait to see how this turns out.
