CZ and Binance face lawsuit for allegedly assisting cybercriminals in money laundering

On August 16th, Binance and its former CEO Changpeng Zhao (CZ) were hit with a lawsuit, accused of facilitating money laundering activities involving stolen cryptocurrencies, in violation of Anti-Money Laundering (AML) regulations and the RICO Act.

According to documents filed in the U.S. Federal Court in Seattle, Binance, the world’s largest cryptocurrency exchange, and CZ are facing a class-action lawsuit, with plaintiffs alleging that the exchange enabled the laundering of millions of USD worth of stolen cryptocurrency assets, leading to severe breaches of U.S. laws.

The plaintiffs, Philip Martin, Natalie Tang, and Yatin Khanna, claim that Binance allowed their stolen cryptocurrency to be funneled through the platform, ignoring AML regulations and Know Your Customer (KYC) protocols. Additionally, the exchange allegedly avoided registering as a Money Service Business (MSB) in the U.S., which permitted cybercriminals to launder funds and obscure the origins of stolen assets.

The lawsuit further argues that, had Binance adhered to regulatory standards, victims might have been able to track and recover their stolen assets due to blockchain’s inherent transparency. However, Binance’s deliberate disregard for regulations and lack of oversight thwarted these recovery efforts.

It has also been reported that CZ was aware of U.S. customers using Binance's services but chose to ignore the mandatory regulations, which resulted in violations of the federal RICO Act—a law designed to combat organized crime.

If successful, this lawsuit could result in Binance facing damages up to three times the value of the stolen assets, which would significantly damage the exchange’s financial standing and reputation.

In an August 20th post on X, Bill Hughes, a senior counsel at Ethereum Consensys, expressed skepticism regarding the lawsuit's ability to provide sufficient evidence to support these claims.

Hughes mentioned that this lawsuit was expected following recent legal actions against Binance and noted that if it proceeds to trial, it could have substantial consequences for the broader cryptocurrency industry.

He emphasized that, should the case move to the discovery phase, Binance would be under intense scrutiny to prove its capability to track and recover assets on the blockchain. The effectiveness of blockchain analysis tools would also be tested.

Clearly, this lawsuit places Binance in a precarious position, with the potential outcome carrying significant implications for the future of the cryptocurrency industry and its regulatory landscape.

Additionally, this case could pave the way for a wave of new legal actions against other cryptocurrency companies, as authorities and regulators tighten their grip on the market in response to the ongoing challenges faced by Binance.

In the past, Binance has frequently encountered serious legal issues related to AML violations across multiple countries. For instance, in April 2024, Indian authorities fined Binance $2.25 million for violating the country’s anti-money laundering laws. Prior to that, in 2023, France launched an investigation into money laundering and financial regulation breaches involving Binance.

Moreover, former CEO CZ admitted to AML violations after the SEC filed a lawsuit in June 2023. Binance paid a record $4.3 billion fine, and CZ was forced to step down as CEO and serve a four-month prison sentence for facilitating money laundering activities on the platform. CZ began serving his sentence in a California prison in June, with his expected release in September, shorter than the three-year sentence initially sought by prosecutors.

Since Richard Teng took over as CEO, Binance has adopted stricter measures to comply with global regulations. Teng has committed to bolstering anti-money laundering efforts, enforcing rigorous KYC policies, and ensuring legal compliance. These steps have helped Binance prevent user losses amounting to $2.4 billion in 2024. Notably, the exchange successfully re-entered the Indian market on August 15th and reached a settlement with the Brazilian SEC in August 2024.
