***When Citizens v/s Departments in a Court of Law, the Scales of Justice seem Off Balanced.***

*Innocent Until Proven Guilty?*

That means everybody in jail before the are seen in court are innocent? So we jail the innocent. Okay on your first court date you will be asked whether you plead guilty or not guilty. Once the entire court case has been completed you will have been found either guilty or not guilty. No one gets to be found innocent. They will be found not guilty, which would leave the question why do they even say innocent until proven guilty?

I guess it just sounds nice. *

let's face it, the summons itself is a bit intimidating, **The state of North Carolina v/s everyday citizen.** This alone can be very intimidating to some, it sounds as if the entire state is against one little person.*

***Cell Phones...***

Rules about cell phones being brought into the courthouse. Different places have different rules, our local courthouse will tell you to turn around and take it back to your vehicle. However lawyers, caseworkers, DSS workers, district attorney, bailiff, even the judge have their cell phones.

**Okay fine I get it regular people will be irresponsible with their cell phones while all these professionals will keep it professional?**

I have seen a judge snickering while reading her cell phone. I've seen many DSS workers playing Candy Crush. And is it just a bit unfair that they can Google something if they have a question but a defendant can't?*

  **Comfort level**

I can't speak for everybody but I know I'm rather uncomfortable in court. Whether it be from the old wooden hard seats, just wondering what the outcome of the case, uneasy with people in the courtroom that you dont know and so on.  Then you get up to the judge and because of your discomfort level you easily forget important things that you needed to say.

Now as far as the DA the judge and all other court officials, their comfort levels are much different, some of them went to school to do this oh, some of them love their job and want to be there, some of them do it everyday, but mostly all of them usually work together they see each other on a daily basis but know how to speak with each other. The defendant, especially someone completely new to the system might not know how that County does their line up the beginning of the court day. In this County if it's your first appearance you're supposed to get in line with other dependents that's lined up wrapping around the room. If you don't know this then you won't do it and if you don't do this your case will be heard at the end of the day.

***Parking...***

It's definitely not set up for anyone's convenience. If you do happen to find a parking space close to your building the meter will be for 30 minutes to 2-hour Max. So what does this mean for defendants that are there alone with a car? Either get a ticket or get out there move their vehicle to a different parking space so it starts over while risking their name being called and being issued a failure to appear.*

** Public Court - Private Discussions**

Often you will hear either the DA or attorney ask the judge may I approach the bench. Now this is one I'm curious about myself because now you have Team A and Team B discussing something with the Referee about the case and nobody knows what's being said, what's that all about?

Something about this makes me feel as if the case is already determined or if it's been determined based on something else. A good example would be this time I had a district court appointment and nearing the end of it my attorney and DA approach the judge talked privately. My attorney return to me whispering that he's pretty sure I'm going to lose this case but if I can come up with $1,200 he will appeal it and guarantees that it will be thrown out of Superior Court. I accepted and later after a few court dates did win. But since then I have wondered, did he talk to the judge to having found guilty just to squeeze me for some more money. I'll never know.*

*My Son Needed Me / They tried to hide his situation from me*

My second to youngest son had his 2nd court appearance the other day. At first I should let you know that he was in DSS custody living in a group home. He got into trouble and they put him in jail. He's 17 years old and this is the first time he's ever been in trouble. But because he's in DSS custody they refused to let him leave the jail in my custody. As of that court date he had 20 days till he turns 18 and has already been in the jail for a month. It's a bit ridiculous that the DSS can say whatever they want about me being dangerous to my children yet they have no proof I'm dangerous and just between me and all your readers I'm not dangerous to my children nor have I ever been. But regardless how is a jail ever to be considered a safe environment for any child? Then on top of it in 20 days he'll be an adult and he wants to come home why would they milk his time in their custody if he's so close to being an adult. They know when he turns 18 he's coming home they already had me come and collect his things. (All of his things and the Cockroaches that came with them) They say that they will be held liable if anything was to happen to him, I disagree if I sign someone out of jail they are my responsibility.

Basically the story all boils down to is because I was nervous I didn't remember to say the important things while I was in front of a judge. I forgot to point out he would be graduating this year and that he had not been receiving his therapy. I feel that would have helped quite a bit. Because DSS and the JJD are state departments, they can all gather together and discuss the case prior. They were able to tell the judge that I was a poor placement and they completely wanted to reject me based on my children having been taken twice. That did sound bad but what wasn't said was they were taken twice for the same thing but without any proof that it ever happened the second time. I never neglected or abused my children a long time ago I I did some drugs but never around my children. Had it not been for DSS has involvement my children would have never known. They didnt need to know. I do raise my children to be completely against drugs. Drugs will ruin people's lives. But why this woman has such a personal issue against my family I really want to know. We haven't been treated fairly since the beginning. And the department has many ways of getting what they want.

(DSS don't have to follow the laws like the police do. When a couple gets divorced they arent supposed to bad mouth each other to the children. However they badmouth us to the kids and justify it by saying that the kids need to know who there parents are.)

To fix the situation the judge ordered that the DSS and the Juvenile Justice Department needs to come up with a plan on what to do with him so he's not to be left in a jail. Personally I think that was a joke because as I said before we have three weeks to his 18th birthday if they get anything together at all it'll only be for a few days. But as well as I know DSS they'll stretch it out until the day before his birthday.

I can't bail my child out of jail because he's under age 18. In jail you have to act a certain way to be able to make it through jail, that follows people out. My son is immature but in a good way he still has the heart of an innocent child. He actually skipped a grade so he was supposed to be graduating this year. Because of the time in jail I'm not sure he'll be able to graduate now. How can DSS claims that they are in a child's best interest when they do things like leave a child in jail have a child miss graduating and possibly graduate the following year or even ask a child to Dropout on their 16th birthday which they did with him.

That's another story keep checking back I'll keep writing when it comes to mind. If there are any questions or comments I'll try to respond the best I can.*

*And just a quick statement as to what DSS has on me for why they took my children. I was asked to take a drug test I refused as well as my right then they told me that they were going to take my children so aggravated I agreed to the drug test. I was then told that I can't feel pressured into a drug test. I don't know what she meant by that because she was pressuring me but so what, point is my children were took from school that day I never had a drug test even though I was willing. All of my children were drug tested the results negative. Yes my family was completely divided up siblings were divided. I will get into that story going to have it posted on here soon. I have never been charged with anything above destruction of private property whenever I was 17 and I'm 40 now.*

"I'll never get my family back. Not the way it was."

"I wont be described to be a Monster on the news for shooting up the place."

Instead I hope to show the world the truth about DSS and how they can create so much hate

But act like they are doing it for the right reasons.

Its NOT always true!!!

My life one day at a time
My life one day at a time

This is a Blog I decided to start so I could get things off my chest. From an early age age my life has been anything but boring. I've not always been on the right side of the law, and even though I'm 40 now it still keeps getting worse every time it seems to be getting better.
