The Cost of Corporate Fear. How US Sanctions on the ICC Shift Global Business and Tech

On October 9 2026 the Donald Trump administration and Secretary of State Marco Rubio officially introduced large-scale sanctions against the ICC as an institution. This historic decision came just a few hours after former ICC judge Navanethem Pillay was awarded the Nobel Peace Prize. At the same time the US temporarily lifted restrictions on the import of Russian diesel fuel but that topic requires a separate article. Although I wanted to focus more on financial topics this political news will directly affect global business due to the specific nature of American legislation.  

If we break down the sanctions package against the ICC announced by Marco Rubio it involves completely blocking any ICC assets within US jurisdiction and banning American companies or citizens from conducting any financial transactions with the court. American counterparties were given 6 months to terminate their cooperation with The Hague.  

The most interesting part in all of this is the reason for the escalation against the court. Official Washington is protecting its citizens and allies - this applies more to Israel here - from The Hague and its jurisdiction. The trigger for such a radical decision was an arrest warrant issued by the ICC for Israeli Prime Minister Benjamin Netanyahu. The US and Israel have not ratified the Rome Statute and do not recognize the court. The US Office of Foreign Assets Control also made 4 exceptions for The Hague. These exceptions allow transactions for basic maintenance such as cloud servers, pensions, telecommunications and funding for the detention of individuals who have broken the law to some extent.  

At the beginning I already wrote that these sanctions would affect the mechanics of global business. Earlier the Trump administration blocked the corporate email of ICC Chief Prosecutor Karim Khan. The office in turn heavily depended on Microsoft tools for data management and evidence analysis. The ICC understood the risks of being blocked and is proactively abandoning Microsoft products in favor of openDesk which is a German open-source software. This entire precedent where an international structure abandons an American IT giant for security reasons stimulates various European institutions to invest in independent AI models. This in turn could lower the market value of American cloud giants at least within the EU territory.  

I would also like to briefly inform you about the supply of diesel fuel from Russia. Sanctions against Russian fuel have been suspended until April 7 2027 by a general OFAC license. In the US diesel prices jumped to a record $6.53 per gallon. At the same time Trump blamed this on Ukrainian drone strikes on Russian oil refineries which allegedly knocked out nearly half of Russia's refining capacity. This is extremely absurd and politically unethical to shift one's own political mistakes onto other political figures or countries. Against the backdrop of this news the shares of Russian oil and gas companies showed growth while wholesale diesel prices in New York fell by 4.5%.  

I would also like to attach comments from political figures and people who are themselves involved in this sanction expansion.

"Either the ICC stops its threats or we will put an end to the ICC. We expect our allies, many of whom rely on American service members for defense, to restrain the court."

"This is an attempt to interfere with justice through intimidation. The fate of the court now depends on the states that founded it. History will judge this moment."

 

Kaja Kallas, EU High Representative for Foreign Affairs
Stated that the 6-month wind-down period is a "window for dialogue" but emphasized that the bloc has options to protect the vital work of the court. ( Belgium has already called for the activation of the EU blocking statute to protect European companies from American fines ).

"Any easing of sanctions against the Russian Federation without a clear agreement on de-escalation is an obvious weakness. Gifts to Putin will not work for peace, diesel relief will only fund terror."

"This is outrageous. We warned everyone that Trump cannot be trusted when it comes to Russia. Now he is simply removing sanctions on Russian fossil fuel."

 

Let us summarize all of this by saying that the main risk for European companies is fear. The large insurer AXA has already terminated its contract for the medical insurance of 1800 ICC employees and their families. It is easier for them to leave the ICC without insurance than to risk billions in fines from Washington. Also the introduction of sanctions against The Hague right after the Nobel Peace Prize announcement highlights a massive paradox. This exact precedent underscores the widening rift between the US and global institutions. Speaking of fuel I think the market will stabilize for now. However American IT giants are receiving a strong reputational blow in Europe. With these actions they will only accelerate independence and sovereignty in the IT sector within the European Union.
