The end of the tax haven for cryptocurrencies in Belgium.


Belgium has just chosen its new federal government. The new measures have just leaked, cryptocurrency holders will be impacted.

Belgium has always applied 3 taxation models in Belgium, namely 0% taxes for the so-called 'normal' management, 33% taxes for speculative activities and a progressive tax up to 50% for professional activities related to crypto-currencycurrencies. This is the first category, namely normal management that will be affected. No more tax!

The new provisions are still to be clarified but it would appear that the change will target the first category, namely normal management. In detail, the tax would only apply to capital gains realized (therefore on sale), would not be retroactive, and historical capital gains would be exempt. Losses could be deducted within the year and without the possibility of carrying forward (so it would be impossible to deduct a 2026 loss on a 2027 gain, for example). An exemption is also provided for the first 6,000 euros of capital gains per year (this amount has yet to be confirmed, it could go up to 10,000 €). The amount of this tax could be between 5 and 10% on capital gains.

As a reminder, normal management is a category that includes cryptocurrency holders who are not considered to be speculators or professionals in the sector. To not be considered a professional in the sector it is very simple, it is enough not to have a main or complementary activity requiring the creation of such a status. Cryptocurrency miners and independent blockchain developers are for example subject to progressive tax (ranging from 0 to 50%). For speculators, this category includes all the players who have intense activities of buying and reselling digital assets. This category is subject to a 33% tax. Attention if this activity constitutes the bulk of the taxpayer’s income, he could be considered a professional speculator, which requires the creation of a compatible status and taxation according to the progressive scale.

Beware of those who would be tempted not to declare their cryptocurrencies because the EU directive DAC 8, which must still be transposed into Belgian law (by 2026 at the earliest), will bring more clarity. It will force crypto platforms to automatically transfer their customer data to the tax authorities. Compared to other countries, Belgium maintains a system which is still advantageous since in France the amount of this tax is increased to 30%.
