SEC Vs TON, the deposition of the Telegram founder expected between 7 and 8 January 2020

Kevin Castel, judge of the southern district of New York, has ordered that the deposition of Pavel Durov (CEO and founder of telegram) for the case that sees the SEC as opposed to TON takes place between 7 and 8 January next; Ilya Perekopsky, vice president of Telegram, and responsible for investor communications during last year's $ 1.7 billion token presale, will instead be questioned in less than a month, December 16 in London shortly after the hearing of one of the telegram employees whose name appeared in letters sent to customers after the SEC blocked the issue of tokens (Shyam Parekh), scheduled for December 10th. The case, which caused quite a stir when the SEC blocked the listing of the GRAM tokens at the last minute, concerns the alleged circumvention by Telegram of the rules governing the issue of bonds.

The problem is that telegram has not registered tokens as obligations by virtue of the rule that exempts companies from this obligation provided that sales are reserved exclusively for qualified investors; however, since the GRAM tokens would end up being listed on the major exchanges, the SEC considered that the company should have registered its tokens before making them available on the market. The project, in terms of development, is still moving forward and the DEVs continue to work on the network so that everything can be ready when, finally, legal quarrels will have come to an end. Meanwhile, several exchanges have already given their willingness to list the GRAM tokens, among which we can mention Coinbase and Poloniex, two of the largest cryptocurrency exchanges in the world. Chanpeng Zhao (CEO of Binance) also spoke on the issue and said he doubted that projects like GRAM or Libra could be blocked forever by legal actions or in any case following the intervention of regulators; according to CZ, therefore, these are mere setbacks that may delay the issuance of these instruments but will not be able to stop it forever.
