(this is a true story that takes place after a 2 year battle with DSS that ended with 2/3 of our children returning to our custody, the other two children were not allowed to come home according to the court. My oldest son turned 18 while in there custody and was dropped off at a homeless shelter in Hickory. Even though he was not allowed to be around the younger children I still couldn't just leave him helpless in a homeless shelter so we made arrangements to help him.)
One morning while I was at work I got the message that I had an emergency phone call in the office. I stopped working and hurried to the office and could hear my son on the other end of the phone and at that moment he was saying stop get your hands off me. I could hear them and then he started to holler dad DSS's and the police are here to arrest me! I said for what? I heard dss worker say sir he's not allowed to be here with the kids . I asked, what kids are there . She replied none right now, they're still at school but they will come home this afternoon . I proceeded to question who was there and was told, 2 DSS workers and Marion City detective. I heard him Shout again "get your hands off of me" "what are you doing" stop" "dont touch me" and the officer saying just step outside. I then shouted on the phone in front of my bosses that there is no crime being done there is no warrant for arrest then you better get your goddamn hands off my kid and there are witnesses listening to all this. I then told my son he has nothing to worry about and for him to go ahead and just get his things and head on over to his boyfriend's house. He was hesitant to go out because they were outside but I assured him that now that I've let them know that Witnesses are present on the phone no one will touch him and no one did.
They came to my house while I was at work , my wife is at work, all the other children at school. They had access to that information they already knew that information. They just couldn't stand the thought of my son being back around me instead of in the homeless shelter where they left him. There was no crime being committed at this time he was working in Old Fort on third shift and from time to time he would get sleepy on the way home because he lived in Glen Alpine. He knew the rules , as long as the kids were at school he could stop by, shower, take a small nap and need to be up and out by 1 or 2. He is an inexperienced driver at the time and working third shift I wasn't going to expect him to drive that long drive home if he was sleepy. We already had it set up if the kids was to get home from school and see his car still there they knew they were to stay outside until my wife (who usually got home before they did anyway) got home from work she would wake him and have him go on before they came in. We never had to cuz he always did leave before 1 or 2.
Even though they were definitely knowing not to touch him again they still tried to fight their case over the phone by telling me that he answered the door without a shirt on. Go figure a guy asleep wakes to answer the door without a shirt on.
My Questions:
What was the detectives plan if he did pull my kid outside?
If he hadn't thought to call me and have me on speaker at that very moment what was going to happen to him that day? We have an officer trying to pull him out the front door of my home without a warrant or crime.
Who were the two DSS Workers? I do believe Jan McCall was one of them. She seems to have a personal interest in my family.
