According to The Week, Alvin Bragg has stated that Trump had a scheme to "commit another crime" or two through falsifying business records (the chief accusation of the indictment).
"Trump's illegally disguised 2016 hush money payments were part of a larger scheme that violated undisclosed state and federal election laws."
Gosh, well there's a surprise, right?
Brag has to convince a jury that Trump's motivation was to influence election results in his favour, not for personal reasons.
Trump's team has argued that the payment to pr0n actress Stormy Daniels was "a personal expenditure, not a campaign expenditure". However, the Donald only paid Daniels once his campaign hit a rough patch, despite wanting to delay until after the election (when the story getting out would no longer matter, according to sources). The joke's on him, though, since Daniels took the money and wrote a book about it anyway. (No, I haven't read it, nor do I intend to.)
There are apparently thirty-four (34) nearly-identical charges against Trump for committing fraud (or intent to do so), each of which carries a sentence of up to four years in prison. However, those convicted of such charges rarely serve the maximum term, according to Politico. The clincher seems to be that Trump deliberately "hid damaging information from the voting public during the 2016 presidential election", according to Bragg's statement of facts. The claim is that election laws were violated (although which specific ones isn't stated).
If I understand correctly, Trump also misfiled his taxes (except that he paid more than he was supposed to). Since the deception might have actually benefited the state, Trump and Michael Cohen have not been charged with fraud or tax evasion for their antics. (Moral of the story: A wealthy businessman can get away with just about anything if you make sure the government gets a fat slice of the pie.
