USPTO Rejects Trademark Application for Dogecoin (DOGE)

By COINTURK NEWS | Cryptocurrency-News | 24 Aug 2023

The United States Patent and Trademark Office (USPTO) recently rejected a trademark application for the largest memecoin Dogecoin (DOGE). This rejection decision is significant in terms of Dogecoin's team winning the trademark battle they have been fighting for some time.

Details of the USPTO's Rejection Decision

The rejection decision states that the applied trademark is generic for the services of the applicant. This situation can create a legal precedent and prevent others from turning anything related to Dogecoin into a trademark in the United States. The Dogecoin community has long been concerned about the commercial branding of the memecoin, and this decision is seen as a positive outcome that preserves the decentralized principle of memecoin.

In the trademark application in question, the aim was to register a circular medallion design with the popular Shiba Inu dog and the letter "D" included. The purpose ranged from educational conferences in Blockchain technology to software development in distributed computing platforms. However, the application was rejected not only because it was "merely descriptive" but also because it was determined to be generic.

According to US laws, even if generic terms have acquired distinctiveness or secondary meaning, they cannot be registered as trademarks.

USPTO's Decision Earns Appreciation from the Dogecoin Community

The Dogecoin community generally expresses their satisfaction with the USPTO's decision. RichDevX, one of the prominent members of the community, congratulates the institution's rejection decision, while mishaboar, another member of the Dogecoin community, appreciates that the institution has meticulously reviewed and understood the history of Dogecoin.

Despite the optimistic view of the community, it is important to note that the decision of the USPTO is not yet final. There is always a possibility of the institution making a mistake in future evaluations, which could undermine this recent achievement for Dogecoin.

The decision still faces future evaluations and legal challenges. This indicates that the Dogecoin community needs to remain vigilant regarding similar trademark applications.
