I have been following the case aginst Ripple XRP brought by the SEC. I originally thought, as earlier post I wrote about indicate that the case would have been settled in December 2022. That did not happen.
Today, the Judge overseeing the case allowed the "Hinman Speech" documents to be used as part of Ripple's defense. See the article here:https://www.coindesk.com/policy/2023/05/16/sec-cant-seal-docs-tied-to-hinmans-ether-speech-judge-in-ripple-suit-rules/
I don't know if you know, but the Hinman speech occurred in 2018. An SEC official at the time, made a speech stating Ethereum was not a security. I, as many others have written about believe that most if not all cryptocurrencies are not securities. I have this in past posts. This decision today does not guarantee that Ripple will win the case, but it definitely is a step in the right direction.
If the case against Ripple is dropped or if Ripple wins the case, the cryptocurrency market will have a significant and immediate boost in prices and interest. I am not saying it will for sure lead to the next bull run, but that is not out of the question.
Whether or not cryptocurrencies are ultimately determined to be labeled securities (I don't see how) or if they are determined to commodities, that decision will be a settling and determining factor on the short and long term outlook and regulation of cryptocurrencies.
I have written about the need for regulation and clarity in the space. We are heading in that direction!
