I have been following the case between the SEC and Ripple XRP.
Yesterday Judge Analisa Torres denied the SEC's appeal in the Ripple case from the summer of 2023. This second article talks about a trial date is now set for the case. As of now the trial is set for 4-23-2024.
What does this mean?
Here is my interpretation. It may mean the SEC drops the Ripple case. We will see about this as it seems that the SEC chaired by Gensler has significant bias and from what I can tell blinders on when it comes to cryptocurrency.
It also means that there is precedent set regarding cryptocurrency not being identified as a security. This is important as the SEC identified 68 cryptocurrencies as securities in June 2023. Another point I want to make is that it is following a theme that I have been writing about. Cryptocurrency needs wins, it needs to be found stable and something real, something you can count on. THE SBF trial was one of those things I wrote about yesterday, this is another thing that is in the positive. We all know that at some point a bull run is coming. A year ago I thought it would already be here. However, with current global sentiment I am not surprised there is hesitancy in cryptocurrency and in finance in general. The DAY cryptocurrencies are labeled as commodities, is the day prices skyrocket. It will be the day cryptocurrencies have a solid foundation for which the broader public and old world financial systems will see it as something to invest in a broad scale.
I am happy that the SEC is put in it's place. They are overreaching with cryptocurrency. It is clear by most reasonable minds not biased that cryptocurrencies do not meet the Howey test. Buying a cryptocurrency is like buying a baseball card and storing it in the hoes it goes up in value. That is not a security, neither is cryptocurrency.
