Diversification Exemption
FINMA waived standard risk-diversification rules, allowing the fund to hold Bitcoin directly.
Market Impact
Previously swiss swiss investors can access crypto only via debt base exchange traded products ETPs or restricted to qualified/professional investors; this marks the first time retail investors get a direct fund wrapper. In this market shift to make this retail ETF possible, FINMA granted a specific regulatory exemption:
• Alternative Classification
The fund is now legally structured as an "other fund for alternative investments."
• Diversification Waiver
FINMA waived standard Swiss risk-diversification rules, allowing the fund to hold Bitcoin as its sole underlying asset.
• Direct Ownership
Unlike ETPs, this structure will gives the funds direct ownership of the underlying cryptocurrency.
Investor Guardrails and Risks
While the approval marks a major milestone, Swiss regulators are also told about the risk it may carry. FINMA issued an explicit volatility warning, reminding the public that Bitcoin always remains in high risk of extreme price fluctuations as drop and bomb it can be because of any happening in market or real world which can fluctuate it .
To protect retail participants, strict compliance measures have been enforced:
• Bankruptcy Protection
Custody protocols must strictly align with FINMA's updated guidelines, ensuring investor assets are ring-fenced and fully protected in the event of a custodian bankruptcy.
• Suitability Checks
Financial advisors and platforms distributing the ETF must comply with the Swiss Financial Services Act (FinSA/Fidleg), which mandates strict appropriateness and suitability checks for retail buyers.
What This Means for the Crypto Markets
This approval could serve as a catalyst for other European jurisdictions to follow suit. By shifting from debt-structured ETPs to direct asset ETFs for the public, Switzerland is validating Bitcoin's place in traditional retail portfolios under one of the strictest financial regulatory frameworks in the world.
Trading on the SIX Swiss Exchange is expected to go live in the coming days.
