Anti-abortion politics = repressive and authoritarian governance

By Vladan Lausevic | Vlad's politics | 25 Jun 2023

A recent article via The Unpopulist blog highlights that anti-abortion politics, despite their ambitions, demand very repressive and authoritarian governance.

The first anniversary of the Dobbs v. Jackson Women's Health Organization ruling marks the conservative Supreme Court's decision to overturn Roe v. Wade and Planned Parenthood v. Casey, which had protected women's reproductive freedom for 50 years. This ruling has resulted in a patchwork of laws across states, with some states approving constitutional amendments to protect abortion rights. In contrast, others have made it illegal or severely restricted it. Even states that protect abortion access still impose heavy regulations on the procedure.

Enforcement of these laws has led to harsh penalties for providers, including fines, jail time, and license suspension. Some states now consider criminalizing and prosecuting women seeking abortions, blurring the distinction between targeting providers and patients. In extreme cases, "pro-life" Republicans have proposed bills imposing the death penalty on those who undergo abortions. The restrictions on abortion drugs, like mifepristone, are also increasing, potentially leading to a dangerous black market and infringing civil liberties.

Texas has set the trend by deputizing private citizens to enforce abortion laws through "bounty hunter" laws, allowing them to sue anyone who aids or helps someone get an abortion. Idaho has followed suit, even punishing those who help minors travel out of state for an abortion. Some conservatives seek to ban commonly used abortion medications and impose jail time for "trafficking" abortion pills.

While the abortion ban in Texas faces legal challenges, there is a potential for future lawsuits and restrictions on abortion medications. Draconian enforcement of abortion bans at the state level may lead to a national ban. However, this could face backlash as most Americans support abortion rights, especially in the first trimester.

In summary, the Dobbs ruling and subsequent state laws have had far-reaching consequences, resulting in a complex web of abortion regulations and enforcement measures. These restrictions and enforcement tactics threaten women's reproductive rights, privacy, and civil liberties. The extreme proposals by the pro-life movement may ultimately backfire as public support for abortion rights remains strong.
