SBF Legal Team Cites Autism Spectrum Disorder

In this post I will be looking at the recent news of Sam Bankman-Fried's legal team making a case to the judge that his autism traits should be taken into consideration when his prison sentence is determined.



SBF Autism

The lawyers of former FTX CEO Sam Bankman-Fried (SBF) have argued that the judges deciding on their clients sentence should take into consideration his autism traits before determining his prison sentence. As things stand SBF is facing a a maximum of 110 years behind bars for his seven counts of money laundering, wire fraud and securities fraud.

His defence team have argued that a sentence of 5 to 6.5 years is fairer given he is 'uniquely vulnerable' in a prison population. This is according to a legal filing submitted on Tuesday the 27th of February 2024. Within the filing SBF's lawyers noted:


“Because individuals with ASD (autism spectrum disorder) may have difficulty responding to certain social cues and contexts, they are at risk from both other inmates and prison guards who may view their failure to respond ‘appropriately’ to social cues as disrespectful or disobedient.”


The defence of SBF have noted that their client “has outward characteristics typical of neurodiversity”. In order to avoid miscommunication SBF has been forced to practice facial expressions and to maintain consistent eye contact. They also noted how at times SBF has come across as “abrupt, dismissive, evasive, detached or uncaring.”

They argued that SBF, like other ASD-positive individuals, “lack[s] […] conventional effect [s], combined with odd gestures and lack of eye contact, [this] can reduce our ability to feel empathy towards them, and can lead us to jump to negative conclusions about their true motivations and feelings.”

Due to the nature of prisons often having “unwritten rules” typically devised by fellow inmates, the filing also noted how people with autism spectrum disorder have a hard time picking up on social cues and are at greater risk of falling foul of these so-called rules.

With SBF turning 32 on Wednesday the 6th of February 2024, his lawyers are doing their utmost to get him a much lighter sentence. They have also Judge Kaplan to consider not only SBF's diagnosis on the autism spectrum, but also to look at his age and charitable endeavours. His lawyers wrote:


“When the factors are considered, including Sam’s charitable works and demonstrated commitment to others, a sentence that returns Sam promptly to a productive role in society would be sufficient, but not greater than necessary, to comply with the purposes of sentencing.” 


Given the scale of the FTX case, being one of the largest cases of financial fraud in history, the lawyers have also argued that given the likely outcome of the FTX estate reimbursing their creditors for their losses then it will be a “zero loss” case. The family of SBF have also pleaded to the judge for leniency this week, citing similar reasons to his lawyers.
