SEC Ordered to Respond to Coinbase's Mandamus Petition on Crypto Market Regulation

And Now Gensler!

Just around the week: A US high court has issued an order for the securities market regulatory agency, the Securities and Exchange Commission (SEC), to respond to the petition submitted by Coinbase. The text order issued by the court stipulates that the agency must respond within 10 days from the date of the order, while Coinbase has 7 days to reply to the response.

The story

On April 25, 2023, the American cryptocurrency exchange Coinbase filed a legal petition against the Securities and Exchange Commission (SEC), which is tasked with regulating and supervising the securities market and related activities, to force it to respond with a yes or no to a document requested in July of last year, in which the company sought clarification on the rules that the regulator intends to apply to the cryptocurrency industry.

The petition, called Mandamus, is a type of legal petition where the aggrieved party presents a request to the superior court to order a public entity, government agency, or even a public official to fulfill a legal obligation or take specific action.

In general, mandamus  petitions are used to challenge actions or omissions by government authorities that harm the rights or interests of an individual or organization. In cases like this, the party filing the mandamus petition usually argues that the public authority is not fulfilling its legal duty or is not acting in accordance with the law.

In the case of Coinbase, the company filed the mandamus petition against the regulator to demand a clear response to its request for the creation of a law regulating the crypto market. The mandamus petition is a way to pressure the agency to take specific action, in this case, to respond to Coinbase's request.

Continuing with the central theme of the article,

What Coinbase demands is a clear response from the regulator regarding regulatory law and to put an end once and for all to the uncertainty that the company believes exists in the market.

However, the agency has not yet responded to the request, and now the court has issued this order for the agency to provide a response to Coinbase within 10 business days, and the company must also give its reply brief within 7 days. It is still unclear how the regulatory agency will respond to this order, but the court order suggests that Coinbase may be one step closer to obtaining a clear answer from the SEC regarding its position on crypto market regulation.

And now, "if" the regulator does not respond?!

Well, if the regulator refuses to respond to Coinbase's petition, this could have legal consequences and may result in additional actions by Coinbase or the court. The Securities and Exchange Commission's (SEC) refusal to respond may be considered a violation of the agency's legal duty to make decisions and respond to public information requests.

This action may lead Coinbase to take additional legal measures, such as requesting that the court issue a writ of mandamus requiring the agency to respond to the petition. The court may then order the regulator to provide a clear and direct response to Coinbase's request or explain the reasons for its refusal to do so.

The regulatory agency's refusal may also have negative effects on the entity's reputation and raise concerns about transparency and government accountability. Therefore, it is in the regulator's interest to respond to Coinbase's petition to ensure that legal obligations are fulfilled and to inform the public concisely.

To conclude, Coinbase is one of the largest cryptocurrency companies in the world, with a market value of around $13 billion. The company is known for its secure and reliable trading platforms, and has been a vocal advocate for cryptocurrency market regulation to ensure investor protection and market stability.

The Securities and Exchange Commission (SEC), on the other hand, is the primary regulator of securities markets in the United States and has been criticized for its lack of clarity regarding cryptocurrency market regulations, which has led to uncertainty and volatility in the market.

The agency's decision regarding cryptocurrency market regulation will have significant implications for all cryptocurrency market participants. Coinbase is committed to working with regulators to ensure that the cryptocurrency market is safe, fair, and transparent for all users, and hopes that the agency will provide a clear and conclusive response soon.
