After seeing parts of the Kyle Rittenhouse trial, I was wondering what a trial would look like if attorneys had to be sworn in and were not allowed to lie in court.
If attorneys were prosecuted and punished for lying to the jurors then the trials would look a lot different. The punishment would have to be more than money so rich attorneys couldn’t just pay a fine, which isn’t much of a punishment to them.
I believe many (possibly most) jurors believe a prosecutor just because he is “enforcing the law”, so the assumption is that they are more reliable than attorneys that represent the defendant. We know there are some corrupt prosecutors but how do we know which ones if we automatically believe them because of their job.
If there were laws that made everyone lying in court illegal AND they were enforced, then the trials would look a lot different. Witnesses are not allowed to lie in court without possible prosecution, but why not the prosecutors and defense lawyers?
The Rittenhouse prosecutor lied about Rittenhouse carrying a gun across state lines. He lied about him not having any business in the area even though his dad lives there. How many lies did he actually tell? I don’t know. Honestly, I only saw snippets of the trial and I don’t know if I would even be able to spot all the lies. I am sure, however, that the trial would have looked a lot different if the prosecutor hadn't lied.
