Laws are the set of principles, rules, directions, embraced by the state to regulate its elemets. If broken then it is punishable.
There are two distinct kinds of law.
- National law
- International law
National law
- Mandated within the territory of state And to the elements of state
National law encompasses two kinds of law.
- Constitutional law: which governs the srate
- Ordinary law: which governa its people
1) Constitutional law
- It includes all the rules which directly or indirectly affects the distribution or the exercise of power in the state.
- It can have two forms 1. Written and 2. Unwritten
2) Ordinary Law:
- the state is both the child and the parent of law
- It is prepared by competent legitimate authoritues of the state
- It determines the relation of citizen with state and to one another.
- The court solely tajes tge cognizances of this law
Further, for proper comprehension ordinary law is diveded into two
- public law
- Private law
1) Public Law
- regulates the relations of the individuals with the state
- It is made by state for and on the behalf of community
- State punishes the offender against it, if necessary
- It is further divided into two i.e Administrative law AND General law
Administrative law
- Defines in detail the manner in which the government through its barious organs exercises the powers that are conferred upon it by the constitutiinal law.
- It is a part of public law that whoch fixes the organization and determinesthe competence of organs that administer the law
- It also provides/indicates to the individual about the remedies for the violation of his rights.
General law
- determines the relation of private citizens to the state
- It fixes the general and permanent codes of conduct .
- It also sets the qualifications tfor holding a certain position in the state
2) Private law
- some times termed as civil law
- Regulates the relations among the indivuduals
- Prescibes the code of conduct in society in his relation to others
- Gurantees every individual for the enjoyement of their rights
- It concerns to private persons and state is tge arbiter
International law
- Generally it has two types: Public international law AND private international law.
Public international law
- It deals with the relations between the states.
- How they interact ?
Private international law
- It deals with the realation of state to the fireign individuals
- Issues of foreign individual
