Tornado Cash Developer to be Released on Bail

I hope you are all well and having an excellent week, welcome to CryptoGod-1’s blog on all things crypto. Today I will be looking at the recent news regarding Tornado Cash developer Alex Pertsev, who is to be released on bail by the Dutch courts.

 

Tornado Cash

Created in 2019 and the app is an open source, non-custodial, and fully decentralised cryptocurrency tumbler which runs on the Ethereum Virtual Machine (EVM) and all compatible networks. The app offers users the ability to 'mix' cryptocurrencies in an unidentifiable way. This is done by mixing them with other users coins and tokens, and in doing so it creates an obscure trail which is difficult, if not impossible, to follow back to the original source. It is a privacy tool used by EVM networks and stops all transactions being public, which is the default setting with the networks. The project is governed through a decentralised autonomous organisation, or a DAO, and makes use of the $TORN token as a voting system for protocol updates.

In August of 2022 Alex Persev was arrested by Dutch authorities over alleged allegations of involvement in creating Tornado Cash. This happened days after the U.S. Treasury sanctioned the use of crypto mixing services, namely Tornado Cash. The charges brought against him were 'money laundering' based, and of facilitating the process of assisting others in laundering their money via the app. He is charged with this for writing the code that created Tornado Cash.

At the time the U.S. authorities had added Tornado Cash to its Specially Designated Nationals list, effectively banning Americans from using this mixer. They claimed that the mixer was used to launder more than $7bn worth of virtual currency since its creation in 2019.

Many in the crypto community condemned the arrest of Pertsev, given that he created an app and released the code for free use, and was not responsible for how people made use of it. Many felt that his rights had been infringed upon, and Ryan Sean Adams, founder of Mythos Capital and Bankless, came out in his defence stating:

 

“They put a man in jail because bad people used his open-source code. This cannot stand in any free society.” 

 

 

Dutch Court Approves Bail

It was announced in the Dutch Courts last week that Alex Pertsev will finally be released from prison, on bail, before his trial. He had been in prison for near 260 days without any trial or ability to provide a defence, instead forced to wait until his hearing date was set. Finally he is allowed home, as of Wednesday the 26th of April, to be with his wife although he will be under surveillance via electronic monitoring. 

However, he will has his freedom restored, albeit only until his trial date on the 24th of May. There have been surveillance equipment placed in his home and he will also be required to wear an electronic ankle monitor. At the hearing his residency status will be heard, with the Russian national having previously been considered a flight risk. In November of 2022 and again in February of 2023 he was denied bail, but finally that has been accepted by the courts.

Apparently he is unaware of exactly what he has done wrong, and many would agree. Yes he was involved in the creation of Tornado Cash, but he did not willingly nor forcefully make anybody use it. Instead he provided the product and bad actors chose to use it for their own doing. Back in November, when discussing the legal documents he was shown in regards to his case, Pertsev is quoted as saying:

 

“To me, it's more like they don't have to explain anything, they're just doing me a favour. It doesn’t look like I’m here by any law.”
