Sam Bankman-Fried Looking for Temporary Jail Release

The news of SBF being put back behind bars as his bail was revoked was widespread news, but as expected, he has applied for temporary release from jail. This will be in order to work on his defence with his lawyers at the federal courthouse in Manhattan. 

 

 

SBF Temporary Release 

On Friday the 18th of August 2023 the lawyers of SBF sent a letter into US District Judge Lewis Kaplan, where they have stated that their client is not currently in a position to adequately review the extensive documents related to his case. This is due to SBF being detained in the Metropolitan Detention Center (MDC) in Brooklyn, which is notorious for its issues including understaffing. The lawyer representing SBF, Christian Everdell, noted that the government had recently provided him with three-quarters of a million pages of Slack communications, which were apparently due months ago. Everdell stated:

 

“Just last week the government produced three quarters of a million pages of Slack communications, which were supposed to be produced months ago, that Mr. Bankman-Fried will have no hope of reviewing under this schedule.” 

 

He went on to emphasise that it is imperative that SBF is allowed to work closely with his legal team, which would require an internet-enabled laptop for use at the courthouse. This would allow them to expedite the review process, which is crucial with his fraud trial scheduled for October.

The prosecutors of SBF have raised their concerns over the request, stating that his previous compliance with requirements of his bail. They have also stated that SBF has yet to provide all the necessary information regarding the advice he relied on for his actions. They have stated that unless SBF promptly discloses details about the advice he received and its source, he should not be allowed to introduce this defence into the trial.

The prosecutors also offered to load documents onto hard drives for Bankman-Fried's use at MDC, but due to the staffing requirements of a guard to watch SBF while he would be online, the solution of a laptop was unfeasible. They had also discussed the idea of transferring SBF to a smaller, upstate facility where he could access an internet-enabled laptop, but prison officials opposed this idea. 

To add to the misery of SBF, it was revealed on Monday the 14th of August 2023 that he is facing fresh allegations from the Department of Justice (DOJ), including the embezzlement of customer funds. The indictment stated that SBF is accused of misappropriating and embezzling customer deposits from FTX, which amounted to over $100 million in political campaign contributions ahead of the 2022 US midterm elections from stolen funds.
