New U.K. Crypto Enforcement Rules

Welcome to CryptoGod-1's blog on all things crypto. Today I will be looking at new powers afforded to United Kingdom law enforcement agencies which will allow them to seize cryptocurrencies.

 

 

U.K. Crypto Rules

From Friday the 26th of April 2024 U.K. law enforcement agencies will have new powers making it easier for them to seize crypto. These new rules came into effect on Friday after the UK Parliament passed new legislation known as the ‘Economic Crime and Corporate Transparency Act.’ Within the Act there has been an expansion of local law enforcement's authority and steps put in place for these agencies to seize crypto assets at a faster rate than before.

The Economic Crime and Corporate Transparency Act supplements the existing powers of law enforcement agents in confiscating crypto assets easier than before. This means UK Law enforcement will now be able to seize funds before making arrests, similar to the seizure of tangible property, and this amendment has been made to all assets. A press release from the U.K. Home Office noted:

 

“This will make it easier to take assets which are known to have been criminally obtained, even if sophisticated criminals are able to protect their anonymity or are based overseas.”

 

The new powers also allow for law enforcement agencies to destroy crypto assets which would be considered impactable to realise, or could facilitate criminal activity if redistributed back into the wider cryptocurrency market.

 

"Provide for the destruction of cryptoassets if it is not reasonably practical to realise the cryptoassets, or there are reasonable grounds to believe that the realisation of the cryptoassets would be contrary to the public interest, having regard in particular to how likely it is that the entry of the cryptoassets into general circulation would facilitate criminal conduct by any person."

 

The confiscation of cryptoassets via a magistrates’ court issued confiscation orders will allow for powers of withholding cryptoassets via a third party service provider, similar to that of existing funds in bank accounts.

 

"Provide the magistrates’ court (as the authority responsible for enforcement of confiscation orders) the powers to make enforcement orders in relation to third party cryptoasset service businesses, in the same way magistrates can already with funds in bank accounts."

 

Given the United Kingdom have already deployed a number of crypto tactical advisors nationwide, they have already managed to seize hundreds of millions of pounds in cryptocurrency. Back in January 2024 the UK National Crime Agency collaborated with the United States Drug Enforcement Administration and between them there was a $150 million in cash and cryptocurrency seizure from a drug ring.

The new powers will also allow for agencies to transfer funds and manage seized wallets. Assets can therefore now be transferred into a wallet controlled by law enforcement agencies. Some potential coins which could be destroyed, according to the press release, include privacy coins. These are coins which are designed to boost anonymity and reduce traceability.
