The Commodity Futures Trading Commission (CFTC) has announced the reward of around $156 Million towards whistle-blowers this year, with a significant amount having been paid out for crypto-related cases.
CFTC Whistle Blowers Payment and Policy
A press release by Commissioner Christy Goldsmith Romero on the 31st of October 2023 noted the achievements of the Whistleblower policy from the Commodity Futures Trading Commission (CFTC). The release noted the awards offered and associated judgments as financial regulators tighten their activities. The US regulator went on to note that the program had yielded many positive results which have led to a better enforcement regime. They also added:
“Whistleblowers play a vital role in supporting CFTC investigations related to fraud and other illegality. The CFTC could not fully protect customers and markets without whistleblowers.”
The Commission has given away $16 million in awards so far throughout 2023, with a figure of $15 million given out as part of two instances during September. At the time the regulator did not disclose the nature of the cases, but did note that one Whistleblower helped the enforcement open a new line of inquiry. The other instance included a Whistleblower who helped open an investigation and provide key evidence throughout. Commissioner Romero did add that a majority of the tips they have received this year have been from the cryptocurrency industry, specifically the cryptocurrency markets. She went on to add it is an area which continues to have pervasive fraud and ogler illegality.
Throughout 2023 regulators have been ramping up their efforts to effectively regulate the digital asset market. This has come about following the collapse and bankruptcy of several high profile and prominent cryptocurrency exchanges/platforms and led the agency to increase their efforts. Many had complained about the lack of a regulatory framework but Romero commended the efforts of the CFTC’s Office of Customer Education and Outreach as they educated the public on a variety of ways to protect their funds and identify popular scams. Given the expected rise in adoption of cryptocurrency, this is seen as an important move with more retail consumers falling under the purview of the CFTC.
It was back in 2014 when the Commodity began the Whistleblower policy, and according to their in-house assessment it has yielded positive results. Over the previous nine years the Commission has awarded about $350 million to Whistleblowers. In many cases the regulatory ended up obtaining judgement above $3 billion.
The Commission went on to state how the vital role played by Whistleblowers cannot be overstated and they help to identify fraud, interpret evidence, and save time and resources. This has resulted in the mantra “The faster we can stop fraud, the more we can protect customers from harm.”
Over the course of 2023 the regulator recorded the highest number of tips. The number has surpassed 1,520 due to the incentives and protections offered to Whistleblowers.
Some cryptocurrency users have expressed their doubts and dissatisfaction with the lawsuits of the CFTC against the cryptocurrency industry, especially one aimed at executives and firms. However, there are many who are praising the efforts made by both the CFTC and the Securities and Exchange Commission. Pro-regulators have noted that the activities of authorities is pursuing the overall goal of bringing confidence back into the crypto market, while also helping to assure any potential institutional investors. They feel these efforts are eradicating the scepticism which ravaged the space in previous years.
