SEC used Misleading Statements against Binance!

By Aventurine | Crypto Aventurine | 22 Jun 2023

Binance said that the SEC used misleading statements in its lawsuit against the company.

In a blog post, Binance said that the SEC's complaint "is riddled with factual inaccuracies and misleading statements" and that the company "will vigorously defend itself against these baseless allegations."

Specifically, Binance has said that the SEC's complaint:

  • Mischaracterizes Binance's relationship with Binance.US, which is a separate company that is regulated by the U.S. Securities and Exchange Commission.
  • Overstates the amount of U.S. customers who traded on Binance's international platform.
  • Ignores the fact that Binance has taken steps to comply with U.S. law, such as banning U.S. customers from trading on its international platform.

Binance has also said that the SEC's lawsuit is "an attempt to exert regulatory control over the global crypto market" and that it is "a clear overreach of the SEC's authority."

The SEC has not yet responded to Binance's allegations.

It is important to note that the SEC's lawsuit is just that: a lawsuit. It is not a conviction. Binance has the opportunity to defend itself against the allegations in court. It is also possible that the SEC and Binance will reach a settlement agreement.

The outcome of the SEC's lawsuit against Binance will have implications for the entire crypto industry. If the SEC is successful in its lawsuit, it could set a precedent that would make it more difficult for independent crypto exchanges to operate in the United States. However, if Binance is successful in defending itself, it could send a message that the SEC is not able to regulate the global crypto market.
