Unusual Turn in Congress: Vote to Ratify SEC Chairman Postponed


As scheduled, the U.S. Senate Banking Committee held a hearing on March 27 to ratify Paul Atkins' nomination as chairman of the U.S. Securities and Exchange Commission (SEC). 

In addition to Paul Atkins, several of President Donald Trump's nominees for key Cabinet positions attended the session chaired by Republican Senator Tim Scott.

Among them were Jonathan Gould to become Comptroller of the Currency; Luke Pettit to become Under Secretary of the Treasury; and Marcus Molinaro to become Federal Transit Administrator at the Department of Transportation.  

The SEC nominee answered senators' questions, asserting that he will provide a different direction for the agency regarding cryptocurrency. This marks a shift from what the agency had been doing for the past four years under Gary Gensler. 

“One of the top priorities of my presidency will be to work with my fellow commissioners and Congress to provide a sound regulatory foundation for digital assets through a rational, consistent, and principled approach,” Atkins said.  

Because of his experience as a Republican SEC commissioner under President George W. Bush, Atkins has been a target of questions related to the SEC's work in recent years.

Several Republican senators took the opportunity to discuss what they called the Gary Gensler debacle under the Joe Biden administration. They were referring to the measures taken by the former SEC chairman, aligned with what has been described as a regulatory crackdown on cryptocurrency companies. 

“You just have to be able to breathe and not be a complete raging lunatic to be the best SEC commissioner compared to the last guy,” said Senator Bernie Moreno.  

Atkins responded by stating that he will focus his work on ensuring efficient regulation for investors, aiming to “take politics out of the markets.” His goal is to eliminate uncertainty in the cryptocurrency sector. 

At this point, Senator Scott commented that if Paul Atkins is confirmed, “he will return the agency to its core mission: ensuring our capital markets remain the envy of the world.” 

Until then, the majority of the Committee members' attacks had been directed at the SEC's previous management. Criticism of Atkins came later, with the participation of Democrat Elizabeth Warren.  

The senator reiterated her doubts about Atkins' ability to be impartial regarding the digital asset sector, where he has served as an advisor to several companies. She insisted that his ties to cryptocurrencies are “impressive.” 

“His financial ties to the industries he will soon regulate raise serious concerns about his ability to avoid conflicts of interest as a regulator and raise questions about his approach to cryptocurrency regulation,” he added. 

Warren had already expressed these concerns in a letter she sent to the nominee on March 23. In an unusual twist for this type of hearing, it was ultimately learned that the expected vote at the close of the session to confirm or reject the nominations would not take place. The next step in the confirmation process is for the Committee to set a date for this step. It will then submit the results for possible approval by the full Senate.
